Partner Sylvie Gallage-Alwis discusses how environmental litigation must be analysed by companies as the litigation of tomorrow, in Le Monde du Droit.
Sylvie’s article was published in Le Monde du Droit, 23 April 2020, and can be found here.
The French Senate recently largely adopted a draft legislation creating “a new justice for the environment“. This law would aim to improve the judicial system’s response to environmental damages, which are currently rarely prosecuted and carry fairly low sanctions.
Sylvie explains how France must show a change in behaviour in regards to environmental protection to avoid a heavy European sanction. She also explores the benefits of shifting the burden to businesses.
