Biography

Bernhard specialises in international arbitration, with a particular focus on the technology, energy and extractive industries. He also represents clients in contentious and non-contentious private and public international law matters and sits as an arbitrator.

Bernhard is a Professor of Cyberlaw at King’s College London, where he convenes an LLM course entitled “Cyberlaw: Big Data, Algorithmic Governance and Democracy”. He is also a member of the UK Attorney General’s C Panel of Public International Law Counsel to the Crown.

Bernhard has successfully defended sovereign states such as Barbados, Slovakia and the Republic of Kenya in investment treaty arbitrations and acted for a number of states in inter-state disputes and litigations before domestic courts. He recently secured a win for a publicly listed life science equipment manufacturer in a €500m LCIA arbitration involving German, English and Swedish law arising out of a joint development agreement.

Bernhard has acted for claimant and respondent parties in a wide range of commercial and investment treaty disputes (including under the Energy Charter Treaty and ICSID, UNCITRAL, SIAC, ICC, LCIA, VIAC, DIS and AAA Rules), as well as related cross-border litigation and enforcement issues.

Bernhard is recognised in The Legal 500 for his International Arbitration expertise and is also ranked as a Future Leader in the Who’s Who Legal Arbitration Guide. Commercial arbitration

  • Acting for the minority shareholders in a US$230m Singapore-seated SIAC arbitration arising out of the investment in a “unicorn” financial technology company. This case involved complex factual and legal questions surrounding minority shareholder oppression, dilution, buy-out remedies and valuation.
  • Acting for the respondent in a US$20m ICC arbitration arising out of alleged breaches of a long-term services agreement pertaining to the mining industry in a West African Country.
  • Representing the claimants in a £40m LCIA arbitration arising out of a letter of indemnity for payment of legal fees incurred as a result of defending a £1bn+ High Court trial for alleged wrongdoings of the executives of a wind energy company.
  • Representing a Guyanese conglomerate in an UNCITRAL arbitration arising from the termination of a joint venture agreement in the mining industry governed by Guyanese, US and English law.
  • Successfully defended a publicly listed Swedish life sciences equipment manufacturer in a €500m LCIA arbitration arising out of a supply contract for high-tech ancillary equipment. This case involved questions of German, Swedish and English law as well as complex conflict of laws principles.
  • Represented the respondents in a high-profile LCIA arbitration arising out of a series of shareholders’ agreements governing the ownership and management of a leading cloud-computing company in Asia. This case involved complex conflict of laws questions arising out of Russian, BVI and Cypriot law.
  • Represented a major oil and gas company in a commercial arbitration involving a high-value pipeline investment in a Middle Eastern state (ICC Rules). This case involved questions of Yemeni, English and Austrian law.
  • Represented the respondent in an ICC arbitration under the Swiss Arbitration Rules arising out of a construction project in a Central Asian country.
  • Represented a gas buyer in a high-profile Switzerland-seated ICC arbitration pertaining to a long-term contract for the supply of natural gas, including dealing with issues of European Union competition law and the Swiss law of obligations.
  • Represented a Middle Eastern client in a US$100m DIFC arbitration, including in relation to enforcement steps in various jurisdictions around the world.
  • Represented an Eastern European State-owned natural gas company in a €100m VIAC arbitration governed by Austrian law.

Investment arbitration

  • Acting for a privately-owned Swiss mining company in a US$600m UNCITRAL treaty arbitration arising out of the expropriation of the client’s valuable iron ore mining rights in a West African country.
  • Advising a mining company in relation to a potential US$900m treaty claim against a Latin American country arising out of the host State’s expropriation of the client’s investments in a major nickel project.
  • Secured a US$400m ICSID award for a US multinational arising out of the expropriation of a fertiliser plant in Venezuela under the Netherlands-Venezuela BIT.
  • Secured US$455 for Ohio-based bottlemaker Owens-Illinois in an ICSID claim against Venezuela, as well as acting for the claimant in subsequent ICSID annulment proceedings.
  • Successfully defended the Slovak Republic in an UNCITRAL investment treaty arbitration pertaining to an investment in the mineral water sector, including issues of transboundary resource sharing.
  • Advised an institutional investor in relation to a potential investment treaty claim arising out of the expropriation of its investment in a Portuguese bank.
  • Successfully defended the Republic of Kenya in the Cortec v. Kenya ICSID investment treaty arbitration arising out of the revocation of rare earths licences valued at US$2bn.
  • Successfully defended the government of Barbados in an UNCITRAL investment treaty arbitration arising out of the alleged expropriation of an investment in an ecotourism project. The claim was dismissed in its entirety with costs awarded to the respondent.
  • Represented two independent foreign investors in treaty arbitrations against Mongolia, both arising out of gold mining project in the country.
  • Represented the Cypriot investors in the Alapli v. Turkey ICSID arbitration, which arose out of the expropriation of concession agreements for the generation of electricity.
  • Represented the claimant in the Libananco v. Turkey ICSID arbitration, which arose out of Turkey’s alleged violations of the Energy Charter Treaty and the Cyprus-Turkey BIT. The case involved allegations of forgery on the part of the claimant and espionage on the part of the respondent.
  • Represented the Cypriot claimant in a €322m claim against Hungary arising out of the expropriation of a casino concession.
