Biography
Elliott is a commercial litigation and arbitration lawyer. He has particular experience in high-value, cross border disputes, often involving multiple parties and competing jurisdictions. Elliott is a solicitor-advocate with rights of audience in the Higher Courts of England and Wales.
Elliott advises on matters before all levels of the English courts, including the Court of Appeal and Privy Council, other common law jurisdictions such as the BVI, Bermuda and Singapore, and civil law courts including France and Italy. Elliott also has experience in obtaining and challenging a range of interim remedies including worldwide freezing orders and charging orders, as well as conducting enforcement proceedings. Clients include corporates, private equity houses, and UHNW individuals
Elliott trained and qualified at Signature. He has completed a secondment to a specialist funds practise, during which he advised institutional funders on litigation funding agreements and LPs in relation to purchases on the private equity secondary market.
Elliott is a member of the London Solicitors’ Litigation Association (LSLA) and JUSTICE. He also leads a contract law workshop at the London School of English for foreign qualified lawyers.
Experience
- Advising an investment fund in professional negligence proceedings against a global law firm arising out of restructuring advice given in relation to a distressed loan. Recognised as one of The Lawyer’s Top 20 Cases of 2016.
- Acting for ENRC in relation to civil proceedings brought by the SFO regarding legal professional privilege. Recognised as one of The Lawyer’s Top 20 Cases of 2017.
- Acting for an UHNW individual in relation to global proceedings brought against Credit Suisse for losses incurred due to mismanagement of his portfolio in Switzerland, which have led to criminal proceedings against the bank’s fund managers.
- Advising an investment fund in relation to multi-jurisdictional proceedings to recover losses for breach of contract under a SPA.
- Acting for a telecoms company in relation to claims arising out of an SPA, including in relation to summary judgment applications and an expert determination.
- Advised in relation to BVI proceedings concerning an entitlement to US$200 million in a US$1 billion BVI private equity fund, including the successful appeal in both the Eastern Caribbean Court of Appeal and Privy Council.
- Acting for a number of Cypriot trusts in challenging interim charging orders awarded in the course of enforcement proceedings in relation to a judgment in excess of US$300, including appeals to the Court of Appeal.
- Acting for a Kazakh bank in relation to enforcement matters following findings of fraud.
