Biography
Simon is an experienced international litigator and mediator based out of our Gibraltar office.
Simon joined Signature Litigation in 2019 and specialises in complex domestic and multi-jurisdictional commercial, regulatory, trust and probate disputes.
Simon started his legal career at Irwin Mitchell, where he worked in the highly acclaimed Contentious Trusts and Probate, International Personal Injury, and Clinical Negligence teams. He later joined the market-leading Private Wealth Disputes team at Charles Russell Speechlys.
Simon is an accredited commercial mediator with CEDR and has a strong interest in ADR.
Prior to entering the legal profession, Simon spent several years working in international development, foreign affairs and conflict management.
He holds Masters degrees in Psychology and Business Studies from the University of Edinburgh and in Conflictology from the Open University of Catalunya, and completed the GDL and LPC at the University of Law.
He is currently studying the Professional Certificate of Competence in Gibraltar Law at the University of Gibraltar and will obtain the right to practice Gibraltar Law later this year.
Simon is fluent in English and Spanish.
Experience
Trust Disputes
- Acting for a UK-based beneficiary of complex, high value Gibraltar-based trusts in seeking the removal of the trustees.
- Acted for the beneficiaries of a Manx-based trust in a dispute regarding the trustee’s conflict of interest in relation to inter-company loans between a trust-held company and one in which the trustee had a personal interest.
- Acted for beneficiaries of a Jersey-based trust in a multi-million pound dispute with the trustee over unpaid trust income tax liabilities on historic UK-source company dividends distributed to UK resident beneficiaries.
- Acted for a court-appointed Guernsey trustee in respect of five Guernsey based occupational pension schemes suffering liquidity issues, involving investigations into the conduct of the former trustee.
Commercial Litigation
- Acting for a major telecommunications provider in complex proceedings at the Supreme Court and Court of Appeal involving the Regulatory Authority in Gibraltar.
- Acting for a claimant in a professional negligence claim against a life assurer in relation to investments made in their life bond scheme in Gibraltar.
Proprietary Estoppel / Constructive Trust Claims
- Acted for the claimant in a multi-million pound proprietary estoppel claim relating to the family’s country estate.
- Acted for the defendant in a multi-million pound claim for an interest in the family home worth several million pounds.
Contentious Probate Disputes
- Acted for various beneficiaries in disputes relating to the validity of Wills and Codicils, including over concerns about testamentary capacity, knowledge and approval, undue influence and lack of formalities.
Financial Provision Claims
- Acting for the beneficiaries of a multi-million pound estate that is the subject of a claim for reasonable financial provision in Gibraltar.
- Acted for a claimant seeking reasonable financial provision out of her deceased’s partner’s estate in England.
