Sylvie Gallage-Alwis and Elias Boukachabine discuss the implications of the FIVP’s recent decision to recognise a causal link between pesticides and congenital deformity in IADC

By Sylvie Gallage-Alwis & Elias Boukachabine

Partner Sylvie Gallage-Alwis and Associate Elias Boukachabine discuss the implications of the recent decision by the French Pesticide Victims Compensation Fund (FIVP) to recognise a causal link between pesticides and congenital deformity in IADC

Whereas the European Commission has renewed the authorisation of glyphosate for a further 10 years starting from December 15, 2023, the Compensation Funds for the Victims of Pesticides (FIVP) has recently recognised the existence of a potential link between prenatal exposure to glyphosate and the illness of a teenager.

Sylvie and Elias explore the increasing trend of litigation surrounding the use of pesticides containing PFAS, also known as “forever chemicals”, in Europe. They further highlight the manner in which case law is becoming increasingly pro-victim, despite the European Commission’s renewal in December 2023 of the authorisation of glyphosate for a further ten years.

Sylvie and Elias’ article was published on 4 January in IADC, and can be found here.
