Partner Becca Hogan comments in an article published in In House Lawyer exploring the rise of group litigation claims and what General Counsels should be mindful of.

On group claims:

“The question often asked is whether the rise of group claims is driving the growth in funding, or the reverse? I think it’s probably a bit of both. Without funding, there would be no group claims because you wouldn’t have the quantum base to withstand the costs involved. The courts also have a role to play – they’ve shown an increased willingness to hear these types of claims in recent years.”

On PACCAR:

“I don’t think that’s the end of litigation funding, it’s caused a lot more work in the meantime, but it’s not going anywhere. It would be good to get clarity in legislation.”
